MedicalMex Inc. is not a pharmacy. We are a U.S.-based international personalized pharmacy concierge service that helps patients safely access affordable prescription medications by coordinating with fully licensed pharmacies, manufacturers, and healthcare providers across Canada and Mexico.
We do not dispense or manufacture medications. We strictly provide coordination, logistics, and support services through our vetted network of third-party providers.
All medications require a valid prescription issued by a licensed physician. MedicalMex does not offer medical advice, dispense drugs, or create a doctor– or pharmacist–patient relationship.
All information on our website and digital channels is provided for educational purposes only. Always consult a licensed healthcare provider before making any changes to your treatment.

Introduction
This website, located at [ https://www.medicalmex.com/terms-of-use-pharmacy-concierge/ ] and any related mobile application, together with any information stored and services provided therein (collectively, the “Website”), are owned and operated by MedicalMex Inc., a Texas corporation (“Company,” “we,” “us,” or “our”).
The company makes available to registered users (“you” or “Customer”) certain services and access to products offered and/or sold by third-party medical providers and third-party pharmacies. As of the publication date of these Terms of Use, the website may facilitate access to prescription fulfillment services offered by pharmacies located in Mexico (for in-person pickup only) and in Canada (mail-order) (the “Pharmacies”). The company may also provide access to foreign medical doctors who provide healthcare and/or prescription services in connection with the Pharmacies (the “Physicians”).
By accepting this agreement, you acknowledge and agree that any services you receive from the Pharmacies or Physicians through the website are subject to these Terms, and that the Pharmacies and Physicians are independent third parties (and intended third-party beneficiaries only to the extent necessary to enforce the provisions that protect them).
The company does not control or interfere with the method or manner of the practice of medicine or pharmacy services by any Pharmacy or Physician. MedicalMex is not a pharmacy or medical provider, and using the website does not create a doctor-patient, pharmacist-patient, or other professional relationship with the company. However, using the website may result in a direct professional relationship between you and a third-party Pharmacy and/or Physician.
If you are not of legal age to form a binding contract (often 18), a parent/guardian must consent to your use. If you are under 13, you may not use the website. Certain features may have additional terms posted on the website; all such terms are incorporated by reference.
Acceptance
These Terms of Use (the “Terms” or “Agreement”) govern your access to and use of the website and all content displayed or made available through it, including text, graphics, audio/video, software, and code, and information you submit via the website (collectively, the “Website Content”). You agree to be bound by these Terms by accessing or using the website. If you do not agree, do not use the website.
Electronic Communications
When you use the website or communicate with us electronically (phone, text/SMS, in-app messaging, email), you consent to receive electronic communications from us. Code of Conduct
You agree not to use the Website or Website Content unlawfully or in violation of our policies. Prohibited conduct includes impersonation; unauthorized payment activity; posting illegal/defamatory/obscene/abusive content; infringing IP or privacy rights; introducing malware or disrupting services; unsolicited promotions/spam; damaging or impairing our networks; unauthorized access attempts; scraping/robotic access without permission; harvesting other users’ data; reverse engineering the website; or assisting others to do so.
Customer Account
Some features require registration (“Customer Account”). You must provide truthful, accurate, and current information and keep it updated. You are responsible for safeguarding your credentials and for all activities under your Account. Notify us immediately of unauthorized use. We are not liable for losses arising from your failure to secure your Account.
Termination; Remedies; Monitoring
We may suspend or terminate access or Accounts for violations of these Terms or as otherwise appropriate, and may remove content you upload. We may cooperate with authorities and disclose information to comply with the law. We may modify or discontinue any portion of the website at any time. You agree that violations may cause irreparable harm and consent to equitable relief in addition to other remedies. We reserve the right (but have no duty) to monitor use and remove materials in our discretion.

Website Content is for educational and informational purposes only and is not medical, pharmacological, psychological, legal, or other professional advice. It is not a substitute for in-person evaluation, diagnosis, or treatment. If you think you have a medical emergency, call 911. Service Model Clarification
* No shipping from Mexico. Pickup is in person from a third-party Mexican pharmacy/provider.
* Mail-order (if available) is from Canada via independent third-party pharmacies, subject to customs controls and risks beyond our control.
International Sourcing and Regulatory Compliance
We source medications exclusively from licensed pharmacies, distributors, and manufacturers located in Canada, regulated by Health Canada, and Mexico, regulated by COFEPRIS (Mexico’s Federal Commission for the Protection Against Sanitary Risk).
For select high-cost or newly approved medications that are difficult to access in North America, sourcing from licensed European providers may be available—but only upon the client’s explicit request and with prior written authorization. All such products are obtained solely through licensed European manufacturers and distributors operating in full compliance with their respective national and regional regulatory authorities.
These medications are intended strictly for personal use and must be prescribed and supervised by a licensed healthcare professional. MedicalMex does not market or advertise these European-sourced medications publicly, and procurement is limited to concierge coordination in exceptional cases, which is consistent with all applicable international laws and regulations.
No Credentialing; Consent to Telehealth
* MedicalMex does not employ or control the providers listed on the website. However, all third-party providers within our network undergo a preliminary verification process to ensure regulatory compliance. You are solely responsible for confirming whether a given provider meets your personal and legal standards.
* If you consult a practitioner via Telehealth, you consent to receive services using electronic communications and understand the potential risks, such as technical failures, incomplete information, and lack of physical examination. The provider—not MedicalMex—is solely responsible for the care provided.
Limitation of Liability
To the fullest extent permitted by law, MedicalMex and affiliates are not liable for indirect, incidental, special, or consequential damages, including but not limited to data loss, revenue, or business. Our total liability shall not exceed the amount you paid for the affected product or service. No class actions permitted.
Indemnification
You agree to indemnify and hold harmless MedicalMex and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the website, your violation of these Terms, or your interaction with third-party providers.
Account Hold
We may temporarily place a hold on funds or transactions pending investigation if we suspect fraud, abuse, or other prohibited activity, for a period not exceeding 90 days unless otherwise required by law.
Intellectual Property
All content on the website is protected by copyright and trademark laws. You may not copy, reproduce, distribute, or use our content, trademarks, or branding without express permission.
Ownership of Submissions

All disputes shall be settled, if unresolved, by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration is Collin or Dallas County, Texas. You waive any right to participate in class actions or class arbitration. Small claims and motions for injunctive relief may be brought in the courts of Collin County, Texas, which shall have exclusive jurisdiction.
Force Majeure & Survival
We are not liable for failure to perform due to causes beyond our reasonable control (force majeure). The following provisions survive termination of these Terms: Disclaimer; Limitation of Liability; Indemnification; Intellectual Property; Arbitration; and Miscellaneous Terms.
